Terms and Conditions

1. Customer eligibility and information

You must be at least 18 years old to make a purchase, or have the permission and involvement of a parent or legal guardian. You agree to provide accurate contact, payment, email, and, when applicable, shipping information.

2. Products, availability, and pricing

Mikey Clicks may offer high-resolution digital files, print-ready digital files, physical prints, private photography sessions, Photo Pass coverage, and separately arranged custom or commercial licenses. Physical prints may be marked “Coming soon” while ordering is unavailable.

Product descriptions, available sizes, prices, and availability may change. The price displayed on products excludes applicable taxes and shipping fees. Total cost of product, applicable taxes, and shipping fees will be displayed at checkout.

3. All sales are final

Because digital files cannot be returned after delivery and physical prints are made to order, all sales are final. Orders cannot be canceled, returned, exchanged, or refunded for a change of mind, selection of the wrong photograph or size, an incorrect email or shipping address supplied by the customer, or changes made by the customer or a third-party printer, framer, or service provider.

This policy does not limit any right that cannot legally be waived. If you receive the wrong file, a corrupted or unusable download, or a physical print that arrives damaged, materially defective, or materially different from the product ordered, contact MJF Media within seven days of delivery. MJF Media will, as appropriate, correct the file, replace the product, or issue a refund.

4. Digital delivery

Digital purchases are delivered through a private download link or another delivery service identified for that product. A download link expires fourteen days after it is issued. You are responsible for downloading and securely storing your purchased file before the link expires. If the link fails or expires before you download your purchase, contact MJF Media and a replacement link can be sent.

5. Physical prints

When print ordering is enabled, available sizes will be displayed before checkout. Prints are made to order and personally prepared by Mikey Clicks. Production and shipping times are estimates. You are responsible for providing an accurate shipping address. MJF Media is not responsible for delays caused by a carrier or inaccurate customer information.

Different print sizes may require a slight change to the crop. MJF Media makes the final artist-approved crop and preparation decisions needed to preserve the photograph’s composition. Color and brightness may vary reasonably between screens, paper, ink, and lighting; these ordinary variations are not defects.

6. Ownership and permitted personal use

You may display, frame, crop, resize, edit, or otherwise alter the copy you purchased for your personal, noncommercial use. You may personally print a digital file you purchased. MJF Media is not responsible for the appearance or quality of a photograph after it has been altered or produced by a third-party printer or service.

You may give away or resell the single physical print you purchased, but you do not receive the right to make or sell additional copies.

7. Copyright and prohibited uses

A purchase does not transfer copyright, authorship, or ownership of the original photograph. MJF Media retains the copyright and all rights not expressly granted in these terms.

Without prior written permission from MJF Media, you may not sell, license, or redistribute a purchased digital file; sell reproductions; use the photograph for advertising, merchandise, branding, or another commercial purpose; claim authorship or copyright; upload it to a stock-photo service or digital marketplace; or use it to train artificial intelligence or in a commercial dataset.

Personal social-media sharing is permitted so long as you do not claim authorship and do not use the photograph commercially.

8. Commercial use

A standard purchase is for personal, noncommercial use only. Businesses, sponsors, publications, brands, and organizations—and any advertising, promotional, resale, editorial, or other commercial use—require a separate written license from MJF Media. Contact MJF Media before using a photograph for any such purpose.

9. Watermarked proofs and session availability

Watermarked proofs are provided only to help customers locate and select photographs. You may not copy, download, reproduce, publish, remove a watermark from, or otherwise use a proof. Sessions and proofs may be updated, hidden, or removed and are not an archival-storage service.

10. Private surf photography sessions

A private session includes the advertised shooting window for the number of surfers purchased. The current package is approximately 60–90 minutes, includes up to two surfers at the base price, and may include additional surfers for the fee shown at checkout. The finished gallery includes every successful, artist-selected photograph from the session, up to approximately 20 images. This is a maximum, not a guaranteed minimum, because waves, weather, participation, and surf conditions vary.

A paid booking reserves the selected morning time or after-4-p.m. window. Morning booking times run hourly from 6–7 a.m. through 10–11 a.m. and are currently offered only at Rockaway Beach surf spots. Unsafe weather, unsuitable surf, beach-access restrictions, illness, or another condition outside MJF Media’s reasonable control may require a reasonable time or date change. Image selection, editing, and final artistic treatment remain with MJF Media. Delivered private-session files receive the same personal-use license described above.

11. Surf school coverage and Photo Passes

Half-Day School Coverage includes one agreed morning or afternoon session. Full-Day School Coverage includes the agreed morning and afternoon sessions on the same day. Coverage is photography time, not a guarantee of waves, weather, a minimum number of photographs, or a photograph of every participant. The school is responsible for supplying accurate schedules, locations, participant information, and any permissions required for minors. Unsafe weather, surf, access restrictions, or another condition outside MJF Media’s control may require a reasonable time or date change.

A paid school package includes a nonexclusive, perpetual Unlimited School Use License. The purchasing school may use the delivered photographs for its website, social media, advertising, printed promotions, and school materials. The school may crop, resize, and adapt delivered copies for those uses. MJF Media retains copyright, authorship, and the right to display the work. The school may not claim copyright, sell the files as stock, or transfer the license to an unrelated third party.

A Student Photo Pass includes every finished photograph assigned to the selected student album from the identified covered day. It does not include photographs from another date or album. Student files are licensed for the student and family’s personal use, personal printing, and social sharing. The purchaser confirms that they are at least 18 years old or are the parent or legal guardian authorized to purchase for the student. Photo Pass gallery links are private and may not be publicly redistributed.

12. Payments and taxes

Payments are processed by Stripe or another identified payment provider. MJF Media does not directly store your complete payment-card information. By submitting payment, you authorize the total displayed at checkout. Applicable tax will be collected when required. If a clear pricing or technical error affects an order, MJF Media may cancel the order and refund the amount paid.

13. Acceptable website use

You may not interfere with the website; access private, administrative, or customer-order areas without permission; scrape or download content through automated means; circumvent watermarks or access controls; or use the website unlawfully or fraudulently. MJF Media may restrict access when reasonably necessary to protect the website, customers, or photographs.

14. Disclaimer and limitation of liability

MJF Media uses reasonable care in operating the website and fulfilling purchases. To the fullest extent permitted by law, the website is provided as available. MJF Media is not liable for indirect, incidental, special, or consequential loss arising from temporary interruptions, expired links, third-party printing, customer alterations, carrier delays, or unauthorized use of a photograph.

To the fullest extent permitted by law, MJF Media’s total liability for a claim concerning a product will not exceed the amount paid for the affected product.

15. New York law and resolving concerns

These terms are governed by the laws of the State of New York, without limiting any consumer right that applies to you. Before starting a formal dispute, please contact MJF Media so there is a reasonable opportunity to resolve the concern directly.

16. Changes to these terms

These terms may be updated from time to time. The terms in effect when an order is placed will govern that order. The revision date appears at the top of this page.
